Referendum Results - March 2024

A local referendum on the Allithwaite and Cartmel Neighbourhood Development Plan was held on 29 February to decide whether the Allithwaite and Cartmel Neighbourhood Development Plan should be used to help decide planning applications in the neighbourhood area (Allithwaite and Cartmel Neighbourhood Plan).

The result was 259 in favour and 55 against.

The turnout of electors was 20.63 per cent.

In accordance with Section 38A (4) of the Planning and Compulsory Purchase Act 2004 (as amended), the Westmorland and Furness Council must now "make" the plan as more than half of those voting were in favour. The decision to "make" the plan will be made at a Cabinet meeting on 30 April.

When approved, the plan will become formally adopted and have equivalent weight in decision making to the Local Plan as part of the Development Plan.

Following approval, a decision statement confirming the Plan is made along with the made Neighbourhood Development Plan and associated final documents will then be published on the Council’s website and made available for viewing in relevant locations. Relevant individuals, parties / groups will then be notified of where to view the decision statement and made Neighbourhood Development Plan.

Proceeding to Referendum - January 2024

Following designation of the Allithwaite and Cartmel Neighbourhood Area in October 2014, Allithwaite and Cartmel Parish Council formally submitted their Neighbourhood Plan to South Lakeland District Council, under Regulation 15 of the Neighbourhood Planning (General) Regulations 2012. Note that from 1 April 2023 South Lakeland District Council was superseded by Westmorland and Furness Council.

Following consultation on the submission version of the Neighbourhood Plan (between 2 February and 16 March 2023), Independent Examiner, Mr John R Mattocks, BSc DipTP MRTPI FRGS was appointed to consider whether the proposed Neighbourhood Plan meets certain basic conditions set out in law.

The Independent Examiner has issued his report on the examination of the Allithwaite and Cartmel Neighbourhood Plan. The report concludes that the draft plan (the Allithwaite and Cartmel Neighbourhood Development Plan) should proceed to referendum, subject to Amendments being made in line with the Examiner's recommended modifications. This is to ensure the Plan meets the basic conditions. The Examiner's report also concludes that the referendum should cover the neighbourhood area only.

We have published a Decision Statement accepting the recommendations of the Examiner's report and intend to hold a referendum on Thursday 29 February 2024. If the referendum results in a 'yes' vote from the community, the Plan will be 'made' (adopted) and will become part of the development plan for land use and development proposals within Allithwaite and Cartmel Parish until 2032.

Designation as a Neighbourhood Area

In October 2014, Lower Allithwaite Parish Council submitted an application to designate Lower Allithwaite Parish as a neighbourhood area. Following public consultation, the proposed area was formally approved by our Cabinet on 28 January 2015.

Since designation of the Neighbourhood Area, a steering group has prepared a Neighbourhood Plan for Allithwaite and Cartmel Parish. Earlier stages of the process can be viewed on the Allithwaite and Cartmel Neighbourhood Plan website.
