Councillors' register of interests

All members, co-opted members of district, and parish councils must complete a register of interests form to register their financial and other interests.

Councillors must provide the following details:

  • any employment or business, including:
    • the name of their employer
    • name of any firms at which they are a partner
    • details of any directorships held
  • people who paid towards their expenses
  • contracts between themselves or their firm and the council
  • interests in any land or property in the area
  • any licences to occupy land in the area
  • any tenancies held where the council is the landlord
  • membership of organisations, including bodies to which they have been appointed by the council
  • any offer of gifts or hospitality of a value over £50 that they have received in their capacity as a member

Members must complete a register of interests form within 28 days of being elected.

Register of Dispensations

In some circumstances, a councillor or co-optee is allowed to take part in council business even if they have a financial interest in it. These are set out in our Register of Dispensations from Section 31(4) of the Localism Act 2011

In circumstances when a member has a Disclosable Pecuniary Interest in relation to an agenda item, to make representations under the General Public Participation Scheme and Public Participation at Planning Committee Scheme. Such dispensation does not apply to the remainder of the agenda item and upon completing his/her address the member will be required to leave the chamber for the remainder of the agenda item.

Note: In addition to the dispensation above, those Members who due to private or ward activities have to declare bias and predetermination in relation to an agenda item may utilise the General Public Participation and Public Participation at Planning Committee Schemes in the same way as Members who have a Disclosable Pecuniary interest in an agenda item.

Members of Council who are Parish Councillors who may have a DPI in relation to the Parish Budgets that will be funded through the Parish precept and Council tax.

Members who are County Councillors who are involved in the setting of the County Council budget and the consideration of the County Council element of Council tax.

Members who are appointed to Outside Bodies and who may have DPI interests as a result of these appointments (due to receiving any allowance, payment or indemnity) Elements of the budget relate directly to the organisation’s to which they are appointed.

Members who are dual and triple hatted and who may have a DPI due to receiving any allowance, payment or indemnity from the County and Parish / Town Councils.

Members living in Council accommodation and who are affected by plans or programmes in the budget? “housing matters where the member is a tenant of the Council, provided the budget item does not relate to the member’s tenancy or lease.”

Members of the Council who receive Independent Remuneration Panel Members Allowances.

The Monitoring Officer and the Independent Person have proposed that the following Dispensation’s are agreed under Part 3 of the Constitution Responsibility for Council Functions Para 2.7 of the Constitution to allow members to take part in this budget meeting and future budget meetings.

We have the following authority to provide dispensations. The power to grant dispensations with regards to 1, 2 and 3 has been delegated to the Monitoring Officer, in consultation with the Independent Person.

  1. That he/she considers that without the dispensation the number of persons prohibited from participating in any particular matter would be so great a proportion of the body transacting the business as to impede the transaction of business.
  2. That, without the dispensation, the representation of different political groups on the body transacting any particular business would be so upset as to alter the likely outcome of any vote relating to the business.
  3. That, without a dispensation, no member of the Cabinet would be able to participate on this matter.
18 February 2020 Four year period (ending 2024)

Dispensations provided by the Legal, Governance and Democracy Lead Specialist (Monitoring Officer) and the Independent Member under Part 3 of the Council’s Constitution, Responsibility for Council Functions, paragraphs 2.7 and 4.12, for a four year period, relating to Agenda Item Nos. 6, 8, 9, 10, 11 and 12.

The Monitoring Officer and Independent Member have agreed that all Members of the Planning Committee be provided dispensation on the grounds that they consider that, without the dispensation, the number of persons prohibited from participating in any particular matter would be so great a proportion of the body transacting the business as to impede the transaction of the business.

The Legal, Governance and Democracy Lead Specialist (Monitoring Officer) referred to her recent briefing note to Members on interests with regards to Agenda Item No.8 - Local Government Reform and Devolution. She explained to Members that a dispensation has been granted to all Members with regard to allowances in respect of matters relating to Local Government Reform and Devolution for a period of four years.
