1.1 Do you consider that the South Lakeland District Council Land Allocations DPD is legally compliant?
Yes
2.1 Do you consider that the South Lakeland District Council Land Allocations DPD is sound?
No
2.2 If NO please identify which test of soundness your representation relates to by selecting the relevant option(s) below and completing section 2.3.
The DPD is not justified in that it is not founded on a robust and credible evidence base and/or is not considered the most appropriate strategy when considered against the reasonable alternatives.
2.3 Please give details of the change(s) you consider necessary to make the South Lakeland District Council Land Allocations DPD sound, having regard to the test you have identified at question 2.2 above. It would be helpful if you could state your proposed change to the DPD and the reasons why you think it is necessary.
There are currently 9 houses and 1 pub for sale within Penny Bridge/Greenodd as well as a number of unoccupied houses. Although the Parish Plan (2005/6) identified a need for affordable housing, the Housing Needs Survey Report (Oct 2007) only identified a need for 10 houses up until 2012 ie it did not confirm a need for 21 new dwellings within Penny Bridge/Greenodd.

With regard to the proposed development of the field which lies between Oak Vale, High Garth and the Church, RN:152

The South Lakeland Local Development Framework Core Strategy 2010 states in Section 1, Introduction, and Environment “protect the historic environment from harmful change, including buildings of local importance”. The Church is of great local importance to the people of Penny Bridge/Greenodd. It also states under Section 1, Introduction, Housing - “new developments to respect and be sympathetic to the character of the locality”. The Parish Council does not agree that a new development on this site would be sympathetic.

The site proposed at Greenodd/Penny Bridge is on a hill sloping down away from the Parish Church and graveyard. The Church is a focal point and a place of great solace for those in need. The vista from the Church and Churchyard is of great importance to the community.
The Parish Council believe that the intention to build 21 dwellings in close proximity to the Church will alter the nature of the village of Penny Bridge. In paragraph 5.63 of the Land Allocations Development Plan Document proposed submission edition – March 2012 one key issue is stated as “ The need to protect the quality of the surrounding landscape” and “the need to ensure that any new development is sympathetic in scale and character”. 22 new dwellings in close proximity to a 200 year old church and graveyard are not deemed sympathetic and will not protect the landscape.

The document also states “large green field which currently separates the church and existing dwellings”. This is an important point: the Church is of immense importance in the village and it is separated from the houses for this reason.

Aside from this there are numerous concerns regarding flooding at the site. The soil in this field is made up of impervious clay. Surface water is not able to drain away easily from this site. There are also concerns that water runoff will find its way through the old drainage systems into the sewage system. The new sewage treatment plant, opened in 2011, is having difficulty coping with the amount of fresh water entering the system in times of high rainfall. The new vicarage, which was built below the church, had to have foundations of at least 8ft due to the underlying springs that are in the area and the lying water. The newer Ellis Wood development has had, and has caused, numerous problems due to surface water drainage.

Other areas of concern include:
An oil supply pipeline and tank located in the field
The Church sewerage system soaks into the field concerned.
Residents in the houses below the proposed site (RN152) have complained of sewerage backing up.
The site in question is on a steep hill and the residents on High Garth (to the north of the site) will suffer from light exclusion and have their privacy invaded.
Parking in the area is very difficult especially during school hours.

The current financial climate challenges the justification of the document. Demand for new homes is uncertain and there is doubt whether the plan is effective and deliverable.

Full consideration to another site proposed in the area, RN ?192 was not given,
