People have a right to park for free on New Road
Parking on the site is illegal through the
1951 Byelaw where it states that Common land is to be used for
recreational purposes only. No right exists to park vehicles,
advertise vehicles for sale or dump broken down vehicles.
The Council is selling New Road to build more shops and
cafes
The Council is not selling the land or
proposing to build shops.
Tourists and visitors use New Road for free car parking
The car park is normally full by 8am
and is used for long stay parking until 6pm, which therefore
prevents many visitors from using it.
New Road belongs to the public to use as they like
South Lakeland District Council owns the site
and as custodian of the land has duties to ensure its proper use
under the 1910 Management Scheme and 1951 Byelaw.
The public are not being listened to or consulted with
The Council is holding a three-week public
consultation event from 6th – 24th
July. This is an opportunity for the public to learn about
common land status and what this means for New Road. The
Public’s ideas and opinions will also be collected, which will
enable the Council to develop a detailed set of management and
design options.
The proposal is SLDC’s idea
The Council is progressing the 1910 Management
Scheme and 1951 Byelaw. However, the opportunity that New
Road could play in providing a valuable asset for the Town is
identified in the Kendal Economic Regeneration Action plan, a plan
put together by local representatives from both the public and
private sector such as local businesses and public
agencies.
SLDC wants to put a cycle lane on New
Road
Cumbria County Council is proposing to put a
route in the New Road area. The final route will be
determined following the outcome of this consultation.

The Council is forcing people to use its
car parks to earn
money
The Council is not undertaking this project to
force people to use its car parks. The Council does earn
revenue from car park charges which is used to pay for the
maintenance costs of running the council car parks as well as
supporting other services the Council provides to people in South
Lakeland.
No money has been invested in the upkeep
of New Road
SLDC has spent nearly £10,000 in the last two
years on the maintenance of the area on New Road that is currently
used for parking.
