Licence – Cosmetic Piercing, Tattooists, Electrolysis,
Acupuncture and semi - permanent skin colouring
The Local Government (Miscellaneous Provisions) Act 1982 Part VIII
requires that the following types of skin piercing need be
registered with the Council. Applicants wishing to register should
note that as from the 2nd August 2010 South Lakeland
District Council have adopted section 120 of the Local Government
Act 2003 which adds cosmetic body piercing and semi permanent
skin-colouring to the practices which are required to be registered
with the Council.

The Act requires registration to cover both
the person carrying on the practice and the premises used for that
purpose. There are no powers to refuse registration, but the
practice is controlled through compliance with byelaws in each
case.
The applicant must ensure that the procedures,
equipment and facilities used are safe, hygienic, prevent the
spread of disease and comply fully with the general duty of care
required by the Health and Safety at Work etc Act 1974.
It is illegal to conduct cosmetic piercing,
tattooing, acupuncture, electrolysis or semi - permanent skin
colouring unless the registration has been formally approved.
Once an application has been made and a fee
has been paid, an inspector will undertake an inspection of the
premises. If the inspector considers the applicant's procedures and
the premises to be suitable, then registration will be
approved.
The Inspector will also check compliance with
the following bye-law requirements as well as ensuring that general
health and safety requirements are being met. The inspector will be
pleased to offer any advice or give any help if you are unsure as
to how to meet these obligations.
Cosmetic Piercing and Ear piercing
Ear piercing and cosmetic body piercing are
encompassed in the single term “cosmetic piercing”, and an
application to register will cost £110.00 payable to South Lakeland
District Council.
Semi Permanent Skin- Colouring, Tattooing, Acupuncture and
Electrolysis
Please note that Micro-pigmentation,
semi-permanent make-up and temporary tattooing are covered by the
umbrella term “semi-permanent skin-colouring”. Semi-permanent skin
colouring is defined as “the insertion of semi-permanent colouring
into a person’s skin”. An application to register a business
in order to provide the above activities will cost £110.00 payable
to South Lakeland District Council.
