Applications for Planning Permission
377 5/91/1265 ALDINGHAM: The Mews, Newbiggin, Near Ulverston. Single
dwelling.
The Chief Planning Officer referred to the above
application which was refused planning permission at the
meeting on 11 June 1991 (Minute 226 refers) and reported
the contents of a letter received from applicant
requesting reconsideration of the application.
RESOLVED - That the previous resolution be confirmed.
5/91/1131 BROUGHTON WEST: Land on disused railway line, Foxfield
Road, Broughton-in-Furness. Change of use to retail unit.
A Member of the Sub-Committee referred to the above
application which was refused planning permission at the
meeting on 11 June 1991 (Minute 226 refers). He requested
that the application be brought back for consideration of
information which he had been unable to give at the
previous meeting.

5/91/0569 KENDAL: 64 Sedbergh Road, Kendal. Conversion and
extension of existing dwelling into five flats.
REFUSED for the reason below:-
The proposed conversion and extension of this dwelling to
form five flats would constitute an over- development of
the site which would be detrimental to the amenity of
occupiers of neighbouring properties and to the character
of this attractive residential area which in the main is
characterised by large detached properties surrounded by
mature planting and set within generous private gardens.
5/91/0813 MILNTHORPE: Land at 74 Park Road, Milnthorpe. Eight
workshop units (B1, B2, B8).
GRANTED subject to:-
(1) This permission relates to the amended layout plan
number K169/10 deposited with the Local Planning Authority
on 10 July 1991.
(2) No development shall be carried out on the site which
is the subject of this permission until satisfactory
details of finished floor levels have been submitted to
and approved in writing by the Local Planning Authority,
and the development shall not be carried out otherwise

REFUSED for the reason below:-
Sedbergh Drive is characterised by the spacious provision
of front gardens which act as a setting for substantial
dwellings. The Local Planning Authority considers that a
garage positioned in the front garden of the dwelling as
proposed would be visually intrusive into the local scene
and thereby detract from its open and pleasant character.
The proposal, if allowed, would also set a precedent for
schemes of a similar nature which could not be fairly
resisted; the cumulative effect of which would spoil the
appearance of the locality.

(1) Within six months from the date when the building

Local Planning Authority. Any trees/shrubs which are
removed, die, become severely damaged or diseased within
five years of their planting shall be replaced in the next

The scale, design and position of the proposed livestock
building would be detrimental to the character and
appearance of the surrounding residential area and
notwithstanding the presumption in favour of development,
the scale of the building is excessive for the likely
agricultural needs and capacity of the land in question.
5/91/1275 PRESTON RICHARD: Sunny Valley, Endmoor Road, Endmoor,
Nr. Kendal. Residential development. (Outline)
REFUSED for the reasons below:-
(1) The proposal would constitute an unacceptable form of
residential development outside the limits of any
settlement identified in Policies A1, A2 or A3 of the
adopted South Westmorland Local Plan and does not provide
any justification under Policy A4 of that Plan to warrant
a grant of consent in this instance. Low Park is not one
of the settlements recognised in the Local Plan as being
appropriate for fresh residential development and it
follows, therefore, that the proposal falls to be
considered under Policy A4 which states that outside the
settlements suitable for growth in the Plan area, new
residential development will normally only be permitted
where there is agricultural support and justification.
There is no such justification in this case.
(2) In the absence of detailed plans to prove to the
contrary, the Local Planning Authority is not persuaded
that the site can be successfully developed in the form
indicated by the application, i.e. two pairs of
semi-detached houses, nor that a development of this
nature can be served by a satisfactory means of access.

REFUSED for the reasons below:-
(1) The proposed residential development of the land on
the southerly side of the access lane would extend the
body of the village into open, undeveloped land in a
manner which would be seriously detrimental to the rural
appearance and character of this fringe of the village.
(2) The proposal is contrary to Policy A3 of the adopted
South Westmorland Local Plan since the development does
not constitute an acceptable form of infilling or
rounding-off as defined in the Local Plan.
Note - The Sub-Committee adjourned for lunch at 12.30 p.m. followed by

This permission shall be limited to a period of time
expiring on 30 June 1992. The buildings shall be removed
and the site restored to its former condition, at or
before the expiration of the period specified in this
permission.
The offices are constructed of materials of a temporary
nature which are likely to deteriorate and become
unsightly and thereby injurious to the appearance of the
area.

(1) This permission relates to the amended plan number

parking and manoeuvring of two vehicles in accordance with

(2) Before either of the flats hereby permitted is first

agent's letter dated 1 July 1991 and this parking space
shall have been surfaced to match the adjoining hard
surfacing or as shall have been otherwise agreed in
writing with the Local Planning Authority.

and appearance of this rural locality which is also an
Area of Great Landscape Value.
5/91/1330 KIRKBY LONSDALE: 1 Main Street, Kirkby Lonsdale.

GRANTED subject to:-
The kitchen extension roof shall be covered with local
slates, a sample of which shall be submitted to and
approved in writing by the Local Planning Authority.

GRANTED subject to:-
(1) The external walls and roof of the extension and the
garage shall be constructed with materials of the same
type, texture and colour as the external walls and roof of
the existing building or as may be agreed in writing with
the Local Planning Authority.
(2) The permission authorises the erection of an
extension only to the existing dwelling known as "Fell
View" and shall not be construed as permitting the
erection of a separate dwelling unit.

RESIDENTIAL DEVELOPMENT
Land at Westlea, Cartmel (5/89/3500)
385 The Chief Planning Officer referred to Minute 489 (1990/91) which
resolved that planning permission be granted for the above
development, subject to a Section 106 Agreement being entered into
restricting the occupancy of the dwellings to South Lakeland residents
or workers and to low cost housing, the scheme being regarded as an
exception to normal planning policy.
He reported that negotiations had continued and the scheme had now
been reduced to 19 units which included four bungalows, two of which
were mobility bungalows. The Housing Corporation had also agreed that
all the dwellings would now be for rental.
An amended plan and layout was displayed at the meeting.
RESOLVED - That, subject to the applicant entering into an agreement
with the Council under Section 106 of the Town and Country Planning
Act 1990 restricting the occupancy of the dwellings to South Lakeland
residents or workers and to their rental nature, the Chief Planning
Officer be authorised to determine the application.
RETAIL DEVELOPMENT
18 Market Street, Ulverston - Extension (5/91/0436)
386 The Chief Planning Officer referred to the above application which
Members were minded to refuse at the meeting on 11 June 1991 owing to
the effect that the extension would have on the character of the yard.
He reported that a site visit had been made with a Member of the
Sub-Committee when it was apparent that the yard had suffered damage
in the past to its cobbled surface and the gate was in need of
attention.
It was felt that, together with the restoration of the yard and
entrance, some redecoration and lighting to the area would restore the
character of the yard to some extent.
RESOLVED - That the application for the extension be granted, subject
to the restoration of the yard and entrance together with some
redecoration and lighting to the area.
TREE PRESERVATION
South Lakeland District Council (Church Road, Levens) Tree
Preservation (No.38) Order 1981 - Proposed Work on Trees
387 The Chief Planning Officer reported that an application had been
received requesting permission to carry out work on two sycamore trees
numbered T1 and T11 in the above Order.
Tree No. T11 was situated nearest to the roadway and to 1 Church Close
and had branches hanging low over the road and over the house. The
major branches overhanging the house had developed serious splits.
Discussions had taken place with a Cumbria County Council
aboricultural adviser and the owner's tree surgeon and it was proposed
to cut back the split branches, prune the branches overhanging the
road and, in order to maintain an attractive shape, cut back the crown
of the tree to correspond. As Tree No. T1 had grown as one of a pair
with Tree No. T11, it would also be necessary to reshape and cut back
its crown to a lesser extent to avoid windblow and unsightliness.
RESOLVED - That consent be granted for the work as described and as
illustrated on the photographs displayed at the meeting.
South Lakeland District Council (Charney Hall, Grange-over-Sands) Tree
Preservation (No.1) Order 1974 - Proposed Work to Trees
388 The Chief Planning Officer reported that a request had been received
from residents of 27-37 Charney Road to pollard two lime trees back to
the cuts which were made at the time the dwellings were erected and to
reduce the crowns of two beeches to approximately 25-30% of their
present size. The purpose was to reduce the overshadowing of the
adjacent gardens and break the complete enclosure which was oppressive
to the elderly residents and to achieve trees with a spread of 12
feet. The trees which are covered by the above Order form a line
bordering Charney Road and are close to the dwellings.
As the work was not required on safety grounds or because of the
health of the trees, it was considered that the work proposed would
have an excessive and detrimental effect on the appearance of the
trees.
RESOLVED - That
(1) the application be refused; and
(2) the Chief Planning Officer discuss with the applicants a scheme
for trimming branches projecting close to the dwellings.

394 The Chief Planning Officer referred to Minute 845 (1989/90) which

front garden of the above dwelling.
He reported that, following the service of the Enforcement Notice, an
appeal had been submitted to the Department of the Environment and
that prior to the appeal being determined the fence was removed and
the Enforcement Notice complied with.

Unauthorised Sign Adjacent to the M6 at Burton
395 The Chief Planning Officer referred to Minute 247 (1991/92) which
authorised legal proceedings in respect of a sign attached to a silage
trailer in Field 1351 adjacent to the M6 (southbound) if the sign was
not removed by 1 July 1991. He reported that the sign had been
removed.
Certain Members of the Sub-Committee, however, indicated that they
thought the sign had been re-erected.
RESOLVED - That the Clerk and Chief Executive institute legal
proceedings as authorised.
